Belgium's Legal Framework Supports VibeNet
The following legal milestones provide a robust regulatory backdrop for VibeNet’s architecture.
Ergonomics & MSD Regulation Published
The Belgian Royal Decree amending Book VIII of the Codex on Well-Being at Work was published in the Belgian Official Gazette, formally strengthening the legal framework for ergonomics and the prevention of musculoskeletal disorders (MSDs).
Ergonomics & MSD Rules Enter Into Force
This new regulation came into effect, obliging employers to address MSD risks proactively through ergonomic design, risk analysis, and appropriate prevention planning for both new and existing workstations.
New Key Definitions Added
The legislation introduces explicit definitions for terms like ergonomics at work, prevention advisor-ergonomist, MSDs, and MSD risks, thereby clarifying roles and responsibilities within the prevention framework.
Holistic Prevention & Risk Analysis
Employers must conduct structured analyses of ergonomic and musculoskeletal risks, considering physical, cognitive, environmental, and organizational factors. The results must be integrated into the broader prevention policy, the Global Prevention Plan (GPP), and the Yearly Action Plan (YAP). Measures must be regularly evaluated and continuously improved based on new data, workplace changes, and employee suggestions.
Employee Participation & Training
The rules require that employees and prevention committees are educated on ergonomic risks and MSD prevention measures, and involved in risk analyses and planning.
Reintegration Trajectory 3.0 Regulation Published
The Belgian Royal Decree amending the Codex on Well-Being at Work was published in the Belgian Official Gazette and entered into force on January 1st 2026, strengthening the legal framework for reintegration of employees unfit for work and the prevention of long-term absence (RIT 3.0).
Mandatory Active Absence Policy
Employers must include a written procedure in their workplace rules for maintaining contact with employees who are on sick leave, ensuring structured communication throughout absence.
Work Potential Assessment
For employees absent due to health reasons for at least 8 weeks, employers must have their work potential assessed by a prevention advisor-occupational physician, enabling earlier and more tailored reintegration efforts.
Employer Initiation of Reintegration
Under RIT 3.0, employers can start a reintegration trajectory as soon as there is evidence of work potential, and if the employee consents, even from the first day of incapacity.
Employee Requests for Workplace Adaptation
Employees have the explicit right to ask their employer to examine whether workplace adjustments or alternative tasks can prevent incapacity for work, making prevention more employee-driven.
